These Terms and Conditions ("Terms") govern your use of SafecomLink ("Website/Product"), owned and operated by SafecomLink. By accessing or using the Website/Product, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Website/Product.
1. Use of Website/Product/Product
1.1. You must be at least 18 years old to use this Website/Product. By using the Website/Product, you represent that you are at least 18 years old.
1.2. You agree to use the Website/Product only for lawful purposes and in a manner that does not infringe upon the rights of others, including but not limited to intellectual property rights, privacy rights, or any other proprietary rights.
1.3. You agree not to use the Website/Product in any way that could damage, disable, overburden, or impair the Website/Product or interfere with any other party's use and enjoyment of the Website/Product.
1.4. You acknowledge that all content on the Website/Product, including but not limited to text, graphics, logos, images, audio clips, and software, is the property of SafecomLink or its licensors and is protected by copyright, trademark, and other laws.
2. User Accounts
2.1. In order to access certain features of the Website/Product, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
2.2. You are solely responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or device. You agree to accept responsibility for all activities that occur under your account or password.
2.3. SafecomLink reserves the right to suspend or terminate your account and refuse any and all current or future use of the Website/Product if it suspects that you have provided inaccurate, incomplete, or misleading information, or if you violate these Terms in any way.
3. License Types and Terms
3.1 Subscription License. A subscription license grants you the right to use the SafecomLink software and services for the duration of the paid subscription period. Access and features are contingent on maintaining an active, paid subscription. Upon expiration or cancellation of the subscription, access to the software and services will cease.
3.2 Fixed-Term License. A fixed-term license grants you the right to use the SafecomLink software and services for a specific, pre-defined period as stated at the time of purchase. Upon expiration of the term, continued use requires the purchase of a new license or subscription.
3.3 Lifetime License. A "lifetime" license provides you with a perpetual activation key that enables the use of the SafecomLink software for an indefinite period. The activation key itself does not expire. However, the SafecomLink platform includes both locally-executed software components and cloud-based or server-dependent services (such as account management, service updates, and connected features). The perpetual nature of the license applies to the software activation only. Should SafecomLink cease operations or discontinue the relevant service, the locally-installed software activated by your key may continue to function in its then-current state, but server-dependent features, updates, support, and any connected services will no longer be available. SafecomLink makes no guarantee of ongoing service availability beyond its period of active operation, and shall have no liability for the unavailability of services resulting from the cessation of its business operations.
3.4 All licenses - regardless of type, are personal, non-exclusive, non-sublicensable, and non-transferable unless explicitly stated otherwise in writing by SafecomLink. A license may be used by a single named/callsign/device user on a single installation at a time. Use of a license by multiple users, on multiple concurrent installations, or within a shared environment without an appropriate multi-seat or enterprise license is not permitted.
3.5 License Transferability. Licenses issued by SafecomLink are personal to the original purchaser and may not be transferred, resold, or reassigned to another individual or entity without the prior written consent of SafecomLink. This applies equally to licenses purchased directly from SafecomLink or through any authorized reseller or distribution partner.
3.6 License Revocation and Network Access. SafecomLink reserves the right to revoke, suspend, or deactivate any license, and to block or permanently ban any user or device from accessing the SafecomLink network and connected services, at its sole discretion, in response to a violation of these Terms or conduct that SafecomLink reasonably determines to be harmful, abusive, fraudulent, or unlawful. Revocation or banning may be applied to the individual account, the associated license key, or any account identifier linked to the account.
3.7 Enforcement, Graduated and Immediate. SafecomLink operates a two-tier enforcement approach:
(a) Violations subject to prior warning: For less severe or first-time violations, such as misuse of the software in a manner not expressly prohibited or exceeding single-user license limitations, SafecomLink may, at its discretion, issue a written warning and provide a reasonable period to remedy the breach before taking further action.
(b) Violations subject to immediate revocation: Certain violations are considered severe enough to warrant immediate license revocation and/or permanent network ban without prior warning. These include, but are not limited to: reverse engineering, decompiling, or disassembling the SafecomLink software; unauthorized reproduction or distribution of license keys; software piracy or license theft; attempting to circumvent license enforcement or activation mechanisms; use of the software or network for illegal purposes; and any conduct that threatens the integrity, security, or operation of the SafecomLink platform or its user community.
SafecomLink's determination of which tier applies to a given violation is final and at its sole discretion. A warning in response to one violation does not create an obligation to issue a warning for any future violation, including one of the same type.
3.8 No Refund Upon Revocation for Cause. If a license is revoked due to a violation of these Terms, the user forfeits any remaining license term and is not entitled to a refund, credit, or compensation of any kind, to the fullest extent permitted by applicable law.
4. Authorized Resellers and Distribution Partners
4.1 SafecomLink may enter into agreements with third-party companies ("Authorized Resellers") to distribute, market, or bundle SafecomLink licenses with other products or services.
4.2 Regardless of where you purchased your SafecomLink license, directly from SafecomLink or through an Authorized Reseller, your use of the SafecomLink software and services is governed exclusively by these Terms. The terms and conditions of the Authorized Reseller's own website, storefront, or sales documentation do not replace or supersede these Terms with respect to your use of SafecomLink.
4.3 Authorized Resellers are not agents, employees, or legal representatives of SafecomLink. Authorized Resellers are not authorized to make representations, warranties, commitments, or promises on behalf of SafecomLink beyond what is explicitly stated in SafecomLink's official published documentation and these Terms. SafecomLink is not bound by and expressly disclaims any statements made by an Authorized Reseller that exceed or conflict with SafecomLink's official materials.
4.4 For support, license activation, and service issues, users who purchased through an Authorized Reseller should contact SafecomLink directly at info@safecomlink.com or via the official support channels on the SafecomLink website.
5. Third-Party Hardware Disclaimer
5.1 SafecomLink is a software and cloud-based service platform. SafecomLink does not manufacture, sell, warrant, or support any hardware devices, including but not limited to radio transceivers, modems (hardware or software based), or any other physical equipment or software that may be used in conjunction with the SafecomLink software.
5.2 Where SafecomLink licenses are sold by an Authorized Reseller as a bundle together with third-party hardware, SafecomLink's responsibility is strictly limited to the software and services portion of the bundle. All hardware-related warranties, support, repairs, returns, and claims must be directed to the hardware manufacturer or the reseller from whom the hardware was purchased.
5.3 SafecomLink does not guarantee compatibility between its software and any specific hardware device, and compatibility information provided on the SafecomLink website is offered on a best-efforts basis and may change without notice.
6. Intellectual Property
6.1. All content on the Website/Product, including but not limited to text, graphics, logos, images, audio clips, and software, is the property of SafecomLink or its licensors and is protected by copyright, trademark, and other laws.
6.2. You may not modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works, exploit, or distribute in any manner any material or content on the Website/Product without the prior written consent of SafecomLink.
7. Disclaimer of Warranties
7.1. The Website/Product is provided on an "as is" and "as available" basis without any representations or warranties of any kind, express or implied. SafecomLink makes no representations or warranties regarding the accuracy, completeness, reliability, suitability, or availability of the Website/Product or its content.
7.2. SafecomLink does not warrant that the Website/Product will be uninterrupted or error-free, that defects will be corrected, or that the Website/Product or the server that makes it available are free of viruses or other harmful components.
8. Limitation of Liability
8.1. To the fullest extent permitted by law, SafecomLink shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses arising out of or in connection with your use or inability to use the Website/Product.
9. Indemnification
9.1. You agree to indemnify, defend, and hold harmless SafecomLink and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, liabilities, costs, and expenses, including but not limited to reasonable attorneys' fees, arising out of or in connection with your use of the Website/Product or any violation of these Terms.
10. Service Modification and Discontinuation
10.1 SafecomLink reserves the right, at its sole discretion, to modify, update, suspend, or discontinue any feature, product, or service, in whole or in part, at any time. SafecomLink will endeavor to provide advance notice of material changes via the website or by email to registered users.
10.2 In the event that SafecomLink decides to permanently discontinue its services, holders of a Lifetime License will retain the ability to use the locally-installed software activated by their license key, but will lose access to all server-dependent features and services. SafecomLink will endeavor to provide reasonable advance notice of such discontinuation via the email address associated with your account and/or via a prominent notice on the SafecomLink website.
10.3 SafecomLink's liability in the event of discontinuation shall be limited to the extent required by applicable law. SafecomLink is not obligated to provide a replacement product, alternative service, or monetary refund solely due to product discontinuation, except where mandatory consumer protection laws in your jurisdiction require otherwise.
11. Internet Connectivity and Third-Party Online Services
11.1 SafecomLink includes optional features that, when enabled, communicate with third-party services over the internet. These include AI-assisted features powered by online LLM engines such as Google Gemini, live reporting to PSK Reporter, cluster spotting, an email gateway that connects to operator-configured mail servers, Links log forwarding to external logging applications, and in-app actions that may open third-party websites Google Maps, and Google Translate in the system browser. Each of these features can be individually enabled or disabled in the application settings, and it is the operator's sole responsibility to decide which are appropriate for their operational environment and security requirements.
11.2 SafecomLink makes no representations regarding the availability, security, or data practices of any third-party service listed above. Each service is governed by its own terms and privacy policy. To the fullest extent permitted by law, SafecomLink shall not be liable for any loss, damage, or security incident arising from the operator's use of, or failure to disable, any internet-connected feature.
12. Governing Law
12.1. These Terms shall be governed by and construed in accordance with the laws of Israel, without regard to its conflict of law principles.
13. Changes to Terms
13.1. SafecomLink reserves the right to modify or revise these Terms at any time without notice. By continuing to use the Website/Product after any such changes, you agree to be bound by the revised Terms.
