These Terms and Conditions ("Terms") govern your use of SafecomLink ("Website/Product"), including the SafecomLink website, the SafecomLink software, its online services, and the SafecomLink Go mobile app. By accessing or using the Website/Product, you agree to be bound by these Terms. These Terms apply to every copy of the software and the App, however obtained, including a copy received from another person, through a reseller or installed without an internet connection. If you do not agree with any part of these Terms, you must not use the Website/Product.
1. Use of Website/Product
1.1. You must be at least 18 years old to use this Website/Product. By using the Website/Product, you represent that you are at least 18 years old.
1.2. You agree to use the Website/Product only for lawful purposes and in a manner that does not infringe upon the rights of others, including but not limited to intellectual property rights, privacy rights, or any other proprietary rights.
1.3. You agree not to use the Website/Product in any way that could damage, disable, overburden, or impair the Website/Product or interfere with any other party's use and enjoyment of the Website/Product.
1.4. You acknowledge that all content on the Website/Product, including but not limited to text, graphics, logos, images, audio clips, and software, is the property of SafecomLink or its licensors and is protected by copyright, trademark, and other laws.
2. User Accounts
2.1. In order to access certain features of the Website/Product, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
2.2. You are solely responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or device. You agree to accept responsibility for all activities that occur under your account or password.
2.3. SafecomLink reserves the right to suspend or terminate your account and refuse any and all current or future use of the Website/Product if it suspects that you have provided inaccurate, incomplete, or misleading information, or if you violate these Terms in any way.
3. License Types and Terms
3.1 Subscription License. A subscription license grants you the right to use the SafecomLink software and services for the duration of the paid subscription period. Access and features are contingent on maintaining an active, paid subscription. Upon expiration or cancellation of the subscription, access to the software and services will cease.
3.2 Fixed-Term License. A fixed-term license grants you the right to use the SafecomLink software and services for a specific, pre-defined period as stated at the time of purchase. Upon expiration of the term, continued use requires the purchase of a new license or subscription.
3.3 Lifetime License. A "lifetime" license provides you with a perpetual activation key that enables the use of the SafecomLink software for an indefinite period. The activation key itself does not expire. However, the SafecomLink platform includes both locally-executed software components and cloud-based or server-dependent services (such as account management, service updates, and connected features). The perpetual nature of the license applies to the software activation only. Should SafecomLink cease operations or discontinue the relevant service, the locally-installed software activated by your key may continue to function in its then-current state, but server-dependent features, updates, support, and any connected services will no longer be available. SafecomLink makes no guarantee of ongoing service availability beyond its period of active operation, and shall have no liability for the unavailability of services resulting from the cessation of its business operations.
3.4 All licenses - regardless of type, are personal, non-exclusive, non-sublicensable, and non-transferable unless explicitly stated otherwise in writing by SafecomLink. A license may be used by a single named/callsign/device user on a single installation at a time. Use of a license by multiple users, on multiple concurrent installations, or within a shared environment without an appropriate multi-seat or enterprise license is not permitted.
3.5 License Transferability. Licenses issued by SafecomLink are personal to the original purchaser and may not be transferred, resold, or reassigned to another individual or entity without the prior written consent of SafecomLink. This applies equally to licenses purchased directly from SafecomLink or through any authorized reseller or distribution partner.
3.6 License Revocation and Network Access. SafecomLink reserves the right to revoke, suspend, or deactivate any license, and to block or permanently ban any user or device from accessing the SafecomLink network and connected services, at its sole discretion, in response to a violation of these Terms or conduct that SafecomLink reasonably determines to be harmful, abusive, fraudulent, or unlawful. Revocation or banning may be applied to the individual account, the associated license key, or any account identifier linked to the account.
3.7 Enforcement, Graduated and Immediate. SafecomLink operates a two-tier enforcement approach:
(a) Violations subject to prior warning: For less severe or first-time violations, such as misuse of the software in a manner not expressly prohibited or exceeding single-user license limitations, SafecomLink may, at its discretion, issue a written warning and provide a reasonable period to remedy the breach before taking further action.
(b) Violations subject to immediate revocation: Certain violations are considered severe enough to warrant immediate license revocation and/or permanent network ban without prior warning. These include, but are not limited to: any breach of sections 8.3 to 8.9 (including reverse engineering, copying or porting the software, misuse of AI tools, scraping, building competing copies, and misuse of SafecomLink trademarks); unauthorized reproduction or distribution of license keys; software piracy or license theft; attempting to circumvent license enforcement or activation mechanisms; use of the software or network for illegal purposes; and any conduct that threatens the integrity, security, or operation of the SafecomLink platform or its user community.
SafecomLink's determination of which tier applies to a given violation is final and at its sole discretion. A warning in response to one violation does not create an obligation to issue a warning for any future violation, including one of the same type.
3.8 No Refund Upon Revocation for Cause. If a license is revoked due to a violation of these Terms, the user forfeits any remaining license term and is not entitled to a refund, credit, or compensation of any kind, to the fullest extent permitted by applicable law.
4. SafecomLink Go Mobile App
4.1. The SafecomLink Go mobile app (“the App”) is a companion to the SafecomLink software. It works only with a SafecomLink station that holds a valid license that includes the SafecomLink API. The App is available with the SafecomLink editions and packages stated at the time of purchase, and SafecomLink may change how the App is offered or licensed. The App does not add to, extend or replace your SafecomLink license.
4.2. SafecomLink grants you a personal, non-exclusive, non-transferable, revocable license to install and use the App on mobile devices you own or control, only with SafecomLink stations you are licensed and authorized to operate. Sections 3.7(b) and 8 (reverse engineering, piracy, circumvention, copying, AI misuse and trademarks) apply to the App in full.
4.3. Remote operation. The App lets you operate your station from your phone, including sending messages and broadcasts, answering calls, changing frequency, and running beacons and schedules. Every transmission made through the App is made by your station under your control. You remain fully responsible for it, exactly as if you had made it at the station itself, including any rules on remote or unattended operation that apply to your license and location.
4.4. Access to your station. Anyone holding a phone paired with your station can operate that station. You are responsible for keeping your phone, its screen lock and the pairing QR code secure. If a paired phone is lost, or someone should no longer have access, regenerate the access token in the SafecomLink API settings straight away; this disconnects every phone paired with the old token.
4.5. Alerts and notifications are delivered on a best-efforts basis. They depend on your phone, its operating system, battery and power-saving settings, and your local network, and may be late or may not arrive at all. Do not rely on the App as your only way of learning about urgent traffic.
4.6. Distribution and installation. SafecomLink may distribute the App directly as an Android installation file (APK), through app stores, or both. Install the App only from a file or link provided by SafecomLink through its official website or official communication with you. Copies obtained from any other source may be altered or harmful, and SafecomLink is not responsible for them.
4.7. Installing an APK directly requires you to allow your phone to install apps from outside an app store. This lowers your phone’s built-in protection against harmful apps. You do so at your own risk and are responsible for your device’s security. We recommend that you turn this permission off again once the App is installed.
4.8. An App installed directly does not update itself. You are responsible for installing the updates SafecomLink makes available. SafecomLink is not responsible for problems caused by running an outdated version of the App.
4.9. Where you download the App from an app store, that store’s terms also apply to your download. The app store operator is not responsible for the App or for any support related to it.
5. Authorized Resellers and Distribution Partners
5.1 SafecomLink may enter into agreements with third-party companies ("Authorized Resellers") to distribute, market, or bundle SafecomLink licenses with other products or services.
5.2 Regardless of where you purchased your SafecomLink license, directly from SafecomLink or through an Authorized Reseller, your use of the SafecomLink software and services is governed exclusively by these Terms. The terms and conditions of the Authorized Reseller's own website, storefront, or sales documentation do not replace or supersede these Terms with respect to your use of SafecomLink.
5.3 Authorized Resellers are not agents, employees, or legal representatives of SafecomLink. Authorized Resellers are not authorized to make representations, warranties, commitments, or promises on behalf of SafecomLink beyond what is explicitly stated in SafecomLink's official published documentation and these Terms. SafecomLink is not bound by and expressly disclaims any statements made by an Authorized Reseller that exceed or conflict with SafecomLink's official materials.
5.4 For support, license activation, and service issues, users who purchased through an Authorized Reseller should contact SafecomLink directly at info@safecomlink.com or via the official support channels on the SafecomLink website.
6. Third-Party Hardware Disclaimer
6.1 SafecomLink is a software and cloud-based service platform. SafecomLink does not manufacture, sell, warrant, or support any hardware devices, including but not limited to radio transceivers, modems (hardware or software based), or any other physical equipment or software that may be used in conjunction with the SafecomLink software.
6.2 Where SafecomLink licenses are sold by an Authorized Reseller as a bundle together with third-party hardware, SafecomLink's responsibility is strictly limited to the software and services portion of the bundle. All hardware-related warranties, support, repairs, returns, and claims must be directed to the hardware manufacturer or the reseller from whom the hardware was purchased.
6.3 SafecomLink does not guarantee compatibility between its software and any specific hardware device, and compatibility information provided on the SafecomLink website is offered on a best-efforts basis and may change without notice.
7. Radio Licensing and Regulatory Compliance
7.1. SafecomLink is software that controls radio equipment you supply. You are solely responsible for holding every license and authorization required for your equipment, frequencies, modes, power and location, and for operating in line with the rules of your licensing authority. This includes identification, permitted content, encryption, third-party traffic, and remote or automatic operation. SafecomLink does not check whether a transmission is permitted, and is not liable for any transmission made with the software, whether from the station, through the API, or from the SafecomLink Go mobile app.
8. Intellectual Property
8.1. The ownership terms in section 1.4 apply to all content and software of the Website/Product, including the SafecomLink Go mobile app.
8.2. You may not modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works, exploit, or distribute in any manner any material or content on the Website/Product without the prior written consent of SafecomLink.
8.3. 8.3. Scope of protection. The rights of SafecomLink and its licensors cover the Website/Product in every form, including: (a) the software’s source code, object code, binaries, installers and updates; (b) its on-air and network protocol, including its message tags, packet and frame formats, command sequences and handshakes; (c) its features and their design, logic and workflows; (d) the SafecomLink API, its design and its reference documentation; (e) the SafecomLink Go mobile app; and (f) its user interface, documentation, manuals, training material, videos, website content and screenshots. The non-public parts of the Website/Product, including its source code, internal logic and any protocol details not published by SafecomLink, are the confidential information and trade secrets of SafecomLink and its licensors.
8.4. License, not ownership. When you purchase SafecomLink, you purchase a license to use the software and the App under these Terms. You do not acquire ownership of the software, the App or any copy of them, which remain the property of SafecomLink. All rights not expressly granted in these Terms are reserved by SafecomLink.
8.5. No reverse engineering or porting. You may not, and may not help, instruct or allow any person, artificial-intelligence system or automated tool to: copy, modify, translate, port or adapt the Website/Product, or any part of it, to any programming language or platform; or reverse engineer, decompile, disassemble or de-obfuscate it, or otherwise attempt to obtain its source code, internal logic or non-public protocol details, including by running it under a debugger, decompiler or memory inspector, or by capturing and analysing its traffic in order to reconstruct its protocol.
8.6. Artificial-intelligence analysis. You may not upload, paste, feed or submit the Website/Product, or any material derived from it, to any artificial-intelligence or machine-learning system for the purpose of analysing, explaining, reproducing, translating, porting or generating software, protocols or documentation that copy or imitate the Website/Product. “Material derived from it” includes binaries, decompiled or disassembled code, screenshots, user-interface texts, documentation, protocol captures and descriptions of its behaviour. “Artificial-intelligence system” includes chatbots, code assistants, coding agents and model APIs.
8.7. Artificial-intelligence training and scraping. You may not use the Website/Product, its documentation, its website content or its on-air traffic to train, fine-tune, evaluate, ground or build retrieval data for any artificial-intelligence or machine-learning model. You may not use robots, crawlers, scrapers or other automated means to copy content from the SafecomLink website or documentation.
8.8. Competing copies. You may not use the Website/Product, its documentation, or knowledge gained from using, inspecting or testing it, to design, specify or develop any product, feature, protocol or service that copies, imitates or substitutes for the Website/Product or a substantial part of it. This includes passing that knowledge to others, for example in “clean-room” arrangements where one person studies the Website/Product and another builds from the description.
8.9. Trademarks. "SafecomLink", "SafecomLink Go" and the related names and logos are trademarks of SafecomLink or its licensors. You may not use them, or any confusingly similar name or logo, in the name, branding, domain, app-store listing, code repository, project name, keywords or advertising of any product or service. You may not describe any product as “SafecomLink-compatible”, “based on SafecomLink” or endorsed by SafecomLink without SafecomLink’s prior written consent, except for integrations built under section 8.10.
8.10. Permitted integrations and legal exceptions. Using the published SafecomLink API, as documented by SafecomLink, to connect your own applications to a SafecomLink station you are licensed to operate is permitted and is not a breach of sections 8.5 to 8.8. The restrictions in sections 8.5 to 8.8 apply to the fullest extent permitted by applicable law. Where a law that applies to you grants a right that cannot be excluded by contract, such as a limited right to decompile for interoperability, you may exercise that right only to the extent strictly required by that law, only after first requesting the necessary information from SafecomLink in writing, and never to create a product that is substantially similar to the Website/Product.
8.11. Feedback. If you send SafecomLink ideas, suggestions, bug reports or feature requests, SafecomLink may use them freely, without payment, credit or other obligation to you.
8.12. Survival and remedies. This section 8 continues to apply after your license ends or is revoked, and after you uninstall the software or the App. You acknowledge that a breach of this section would cause SafecomLink irreparable harm for which monetary damages alone would not be adequate. SafecomLink may therefore seek an injunction or other urgent relief in any court of competent jurisdiction, in addition to any other remedy. If you breach this section, you agree to pay SafecomLink’s reasonable costs of enforcement, including legal fees, to the extent awarded by a court. SafecomLink may use license, account and callsign records, together with publicly available information, to investigate and enforce breaches.
9. Disclaimer of Warranties
9.1. The Website/Product is provided on an "as is" and "as available" basis without any representations or warranties of any kind, express or implied. SafecomLink makes no representations or warranties regarding the accuracy, completeness, reliability, suitability, or availability of the Website/Product or its content.
9.2. SafecomLink does not warrant that the Website/Product will be uninterrupted or error-free, that defects will be corrected, or that the Website/Product or the server that makes it available are free of viruses or other harmful components.
10. Emergency and Safety-of-Life Use
10.1. SafecomLink and the SafecomLink Go mobile app are communication tools that depend on radio propagation, third-party equipment, power, local networks and operator configuration, none of which SafecomLink controls. Messages, calls, alerts and notifications may be delayed, corrupted or not delivered. SafecomLink is not certified as, and must not be used as, the sole or primary means of communication where a failure could lead to death, personal injury, or damage to property or the environment. Where lives or safety may depend on communication, you must keep an independent, approved means of communication available.
11. Limitation of Liability
11.1. To the fullest extent permitted by law, SafecomLink shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses arising out of or in connection with your use or inability to use the Website/Product.
11.2. Your equipment. The software controls your transceiver, modem, amplifier, antenna tuner, rotator, computer and other connected equipment through CAT, PTT, audio and similar interfaces, and may transmit for long periods or automatically, for example when sending beacons, scheduled messages or files, or when operated remotely through the API or the SafecomLink Go mobile app. You are solely responsible for configuring, protecting and monitoring your equipment, including its power, duty cycle, cooling, SWR, ALC and audio levels. SafecomLink is not responsible for any damage to, or malfunction of, your radio, modem, computer, antennas or any other equipment, however caused, arising from the installation or use of the Website/Product.
12. Indemnification
12.1. You agree to indemnify, defend, and hold harmless SafecomLink and its officers, directors, employees, agents, affiliates, licensors and successors from and against any and all claims, damages, liabilities, costs, and expenses, including but not limited to reasonable attorneys' fees, arising out of or in connection with your use of the Website/Product or any violation of these Terms.
13. Service Modification and Discontinuation
13.1 SafecomLink reserves the right, at its sole discretion, to modify, update, suspend, or discontinue any feature, product, or service, in whole or in part, at any time. SafecomLink will endeavor to provide advance notice of material changes via the website or by email to registered users.
13.2 In the event that SafecomLink decides to permanently discontinue its services, holders of a Lifetime License will retain the ability to use the locally-installed software activated by their license key, but will lose access to all server-dependent features and services. SafecomLink will endeavor to provide reasonable advance notice of such discontinuation via the email address associated with your account and/or via a prominent notice on the SafecomLink website.
13.3 SafecomLink's liability in the event of discontinuation shall be limited to the extent required by applicable law. SafecomLink is not obligated to provide a replacement product, alternative service, or monetary refund solely due to product discontinuation, except where mandatory consumer protection laws in your jurisdiction require otherwise.
14. Internet Connectivity and Third-Party Online Services
14.1 SafecomLink includes optional features that, when enabled, communicate with third-party services over the internet. These include AI-assisted features powered by online LLM engines such as Google Gemini, live reporting to PSK Reporter, cluster spotting, an email gateway that connects to operator-configured mail servers, Links log forwarding to external logging applications, and in-app actions that may open third-party websites Google Maps, and Google Translate in the system browser. Each of these features can be individually enabled or disabled in the application settings, and it is the operator's sole responsibility to decide which are appropriate for their operational environment and security requirements.
14.2. The SafecomLink Go mobile app connects only to the SafecomLink station you pair it with, over your own network. It does not connect to SafecomLink servers or to any other online service. Links in the App to the SafecomLink website open in your phone's web browser, which is outside the App.
14.3. SafecomLink makes no representations regarding the availability, security, or data practices of any third-party service listed above. Each service is governed by its own terms and privacy policy. To the fullest extent permitted by law, SafecomLink shall not be liable for any loss, damage, or security incident arising from the operator's use of, or failure to disable, any internet-connected feature.
15. Governing Law
15.1. These Terms shall be governed by and construed in accordance with the laws of Israel, without regard to its conflict of law principles. The competent courts of Tel Aviv-Jaffa, Israel shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Website/Product, except that SafecomLink may seek injunctive relief or enforce its intellectual-property rights in the courts of any country where a breach occurs or where you reside.
15.2. If any provision of these Terms is found unenforceable, it shall be limited to the minimum extent necessary and the remaining provisions shall remain in full force. SafecomLink’s failure to enforce any right shall not be a waiver of that right.
15.3. SafecomLink may transfer these Terms, and any rights and obligations under them, including issued licenses, to an affiliate or to a successor in a merger, acquisition, reorganization or sale of all or part of its business or assets, without your consent. Your licenses continue under these Terms after such a transfer. You may transfer your license only as allowed in section 3.5.
16. Changes to Terms
16.1. SafecomLink may modify or revise these Terms at any time. The date of the latest version is shown at the top of these Terms, and it is your responsibility to review them periodically. SafecomLink is not required to notify you of changes.
16.2. Revised Terms apply from the date they are published. By purchasing, activating, renewing, installing or updating any license or version of the software or the App, or by continuing to use the Website/Product after revised Terms are published, you agree to be bound by the Terms in force at that time.
